Terms of Contract

 

Note: Eliza Curl Films & Photography will be referred to as the “photographer” below; all clients listed will be referred to as “client.”

 

Payment:

A 50% deposit is due on booking. The photoshoot is not booked until the deposit has been made. Final payments are due at the time the online photo gallery is delivered. All payments are accepted though cash, check, Zelle, CashApp, and Venmo. Late payments will be subject to a 10% late fee per week.  

 

Copyright:

Client may use photos for any and all personal uses. Photos may be shared through social media, shared with family, printed, and kept for all other non-commercial purposes. Photo credit should be given on social media. The photographer may also feature photos on her website or social media platforms. Photos/videos may not be resold in any form by either party.

 

Weather:

Project may be rescheduled without a fee up to 24 hours before shoot time due to extreme weather conditions, including heavy rain, heavy snow, and extreme thunderstorms.

 

Rescheduling:

Client rescheduling for any reason besides harsh weather conditions within 14 days of the agreed upon date is subject to a $25 rescheduling fee. Deposit may be used for up to 90 days following the originally scheduled photoshoot date before it is forfeit. $25 will be deducted from your final payment in the case of photographer rescheduling.

 

Additional Time:

Time used past the allotted time at the photoshoot will be billed at $305/hour.

 

Delivery:

Your full online gallery will be delivered to you within two weeks of the photoshoot, unless otherwise specified at time of booking. All galleries are delivered online by Google Drive and will be available for download for two weeks following delivery. All photos will be provided in digital format only. Printing rights are included in photoshoot price.

 

Product Nature:

All photos are edited in a true-to-life style similar to the photos displayed on the photographer’s website. Basic retouching is included. No excessive Photoshopping will be used in the editing process to greatly alter the subject’s physical appearance or photo background.
